1. WHAT IS THIS PRIVACY POLICY ABOUT?

The Personal Data Protection Act 2010 (“PDPA”) is introduced to regulate the processing of Personal Data in commercial transactions. The PDPA, which applies to all companies that are established in Malaysia, requires us to inform you of your rights in respect of your Personal Data that is being processed or that is to be collected and further processed by us and the purposes for the data processing. The PDPA also requires us to obtain your consent to the processing of your Personal Data. Consequently, we want you to be clear how we are using your Personal Data and the ways in which you can protect your privacy. This privacy policy (“Privacy Policy”) describes what information is gathered, how this information is used, processed and stored, who the information will be shared with, how you can opt out and how you can modify your Personal Data held by us and any other changes that have been made from time to time.

2.GLOSSARY

Definitions. The following words are given the following definitions: 

“Affiliate”

means a person or an organisation controlling us, controlled by us, or under the common control of a person or an organisation controlling us. “Control” means the ownership of the equity shares carrying fifty percent (50%) or more of the votes exercisable at a general meeting (or its equivalent).

“Personal Data”

means any information in respect of commercial transactions that relates directly or indirectly to a data subject, who is identified or identifiable from that information or from that and other information in the possession of a data controller, including any sensitive personal data and expression of opinion about the data subject.

“PDPA”

means Personal Data Protection Act 2010.

“us, we, our”

means Radium Development Berhad [Registration No.    201301009006(1038848-V)] and/or any of our Affiliates.

“user, you, yours”

means you, an individual, persons who is accessing and/or using our property.

“Sites”

means websites, mobile applications, social media pages and other platforms that reference this Privacy Policy.

3. HOW WE DEAL WITH PERSONAL DATA OF CHILDREN (REFERRING TO PERSONS UNDER THE AGE OF 18)

We are not able to contract with you unless you are 18 years old and above. Our Sites, products and services generally do not target children, and we will not collect any Personal Data from children without the consent of their parent or guardian. If you are a child, please ensure that your parent or guardian has read this Privacy Policy and provide their consent to the processing of your personal data in accordance with this Privacy Policy. If we find that we have collected children’s Personal Data without the consent of their parent or guardian, we will take all reasonable steps to destroy or delete that information. If you believe that we have inadvertently collected Personal Data of a child, please contact us using the contact information specified in Section 13 below to request deletion of the Personal Data.

4. WHEN IS THIS PRIVACY POLICY APPLICABLE TO YOU

The Privacy Policy is applicable to all Personal Data we collect via your dealings and interactions with us, including (without limitation) through your use of our Sites, through your visits to and participation in our offices, sales galleries, roadshows, contests and other events, when you submit printed or electronic forms or documents such as registration forms and enquiry forms to us, and when you connect with us via phone and email. It also applies to the Personal Data we collect through third-party sources, including (but not limited to) via referrals and from property agents, property platforms and regulatory bodies.

5. WHAT PERSONAL DATA DO WE COLLECT

The types of Personal Data we may collect include:

  1. Identification and demographic information: name, gender, date of birth, citizenship, marital status, nationality, race, ethnic origin, identification card/passport details, photographs and/or other images;
  2. Contact details: home address, home phone number and mobile number, email address, work address, work number;
  3. Professional and educational information: qualifications, occupation, employer, former employer(s).
  4. Financial and compensation information: salary amount and currency, bank account details, income tax file numbers, income range.

6. HOW WE USE PERSONAL DATA

We Process and use the Personal Data for one or more of the following purposes:

  1. to provide you with our products and services;
  2. to respond to enquiries, feedback and complaints from you;
  3. to provide you with information regarding our Sites, products and services, terms, conditions, and policies;
  4. to carry out our obligations or exercise our rights arising from any contracts entered into between you and us;
  5. to conduct credit assessments and other background checks as we may determine to be necessary or appropriate;
  6. to maintain internal records;
  7. to detect, prevent or investigate crime, including but not limited to fraud, money-laundering, bribery;
  8. to comply with applicable laws, regulations, directions, court orders, by-laws, guidelines, circulars and codes;
  9. to decide on the suitability of a prospective purchaser or tenant;
  10. to manage our properties and tenancies;
  11. to process and manage your purchase of a property from us or your tenancy and provide related services, including (without limitation) vacant possession, key handover, property/estate management, customer care and defect rectification works, clubhouse services, security and customer loyalty programmes;
  12. to conduct research, benchmarking and statistical analysis;
  13. to promote, market and advertise our products and services to you;
  14. to facilitate business transfers in the event or in contemplation of a corporate sale, merger, reorganization, dissolution or similar event;
  15. to support internal business operations.

7. CONSEQUENCES OF REFUSAL OR FAILURE TO SUPPLY PERSONAL DATA

Provision of your Personal Data to us is generally voluntary. However, the refusal or failure to provide Personal Data may result in the following:

  1. the inability of parties to formalize and/or carry out the relevant agreement or transaction in relation to the sale of our property, products and/or services;
  2. the inability for us provide you with the information, products and/or services requested; and/or
  3. the inability to provide you information about our products and/or services and obtaining your feedback on our products and/or services.

8. WHO YOUR PERSONAL DATA IS SHARED WITH

We may share your Personal Data with the following classes of third parties which may be located within or outside Malaysia for the purposes stated above:

  1. any person to whom we are compelled or required to do so under law or in response to a legitimate instruction or order from a court of competent jurisdiction or government agency;
  2. our Affiliates, related companies and subsidiaries, including those established in the future.
  3. third parties who provide related services or products in connection with our business;
  4. government agencies, statutory authorities and industry regulators;
  5. professional service providers, including auditors, consultants, accountants, lawyers, share registrars, poll administrators, scrutineers or other financial or professional advisers;
  6. banks, insurers and other financial institutions;
  7. third-party property management companies/entities;
  8. our agents, contractors, subcontractors, suppliers, service providers and IT solution providers;
  9. any person to whom disclosure of Personal Data is necessary to facilitate a business transfer in the event or in contemplation of a corporate sale, merger, reorganization, dissolution or similar event.

9. TRANSFER OF YOUR PERSONAL DATA OUTSIDE MALAYSIA

We may store your Personal Data on servers located outside Malaysia. We may also disclose or transfer your Personal Data to third parties located outside Malaysia (as specified in Section 8 above) for the purposes set out in Section 7 of this Privacy Policy. By agreeing with this Privacy Policy, you consent to the transfer of your Personal Data to places outside of Malaysia in accordance with this Privacy Policy.

10. SAFEGUARDING OF PERSONAL DATA

We will take all reasonable steps to ensure your Personal Data is kept confidential, and to implement the appropriate administrative and security safeguards and procedures in accordance with relevant laws to prevent unauthorised or unlawful processing of your Personal Data and the accidental loss or damage of your Personal Data.

11. HOW LONG WE RETAIN PERSONAL DATA

We may retain your Personal Data for as long as is necessary to fulfil the purposes for which it was collected, or as long as the law requires. We will take all reasonable steps to ensure that your Personal Data is destroyed, permanently deleted, or anonymised such that the data can no longer be associated with you, when we no longer need to retain your Personal Data.

12. THIRD PARTY CONSENT

In the event you have provided Personal Data of third parties (e.g. your emergency contact person, tenant, authorised representatives, contractors, lawyers, financiers) to us, you represent and warrant that you are authorised to provide their Personal Data to us, that you have obtained their consent to the processing of their Personal Data in accordance with this Privacy Policy, and that you have provided them with this Privacy Policy.

13. YOUR RIGHTS OF ACCESS AND CORRECTION

You have the right (subject to the exceptions set out in applicable laws) to request access to and correction of information about you held by us and in this respect, you may:

  1. check whether we hold or use your Personal Data and request access to such data;
  2. request that we correct any your Personal Data that is inaccurate, incomplete or out-of-date;
  3. request that your Personal Data is retained by us only as long as necessary for the fulfilment of the purposes for which it was collected;
  4. communicate to us your objection to the use of Personal Data for marketing purposes; and
  5. withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and within a reasonable time period.

14. LANGUAGE

In the event of any conflict between this English language Privacy Policy and its corresponding Bahasa Malaysia Privacy Policy, the terms in this English language Privacy Policy shall prevail.

15. CHANGES

We may modify and/or amend this Privacy Policy from time to time. We will upload all changes to this notice on www.radiumdevelopment.com/privacy-policy and/or by such other means of communications deemed suitable by us. As such, please look at our Privacy Policy periodically, and especially before you provide us any of your Personal Data. This Privacy Policy was last updated on the date indicated above. Your continued access and/or use of our Sites, products or services after any changes, revisions or modifications to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
